My Business Terms of Service
The terms and conditions set forth herein constitute the full and complete agreement between you and The Law Office of Nathaniel Gilbert, PLLC, which owns and operates this website. Your agreement to be bound by the terms and conditions below is accepted and acknowledged by your submission of any order or purchase. Should you wish to purchase this package, please click the box indicating that you have read and agree to these Terms and Conditions.
No Client Lawyer Relationship
By agreeing to these terms and conditions, there is no creation of a lawyer-client relationship between any parties in any regard. NG shall not act as attorney or representative in any capacity for any person or entity unless specifically arranged in a separate, written, and signed contract for attorney services.
Services
The Law Office of Nathaniel Gilbert, PLLC (NG) will not provide any services beyond maintaining the video and document content available to you, the subscriber. NG takes no responsibility for providing additional guidance or legal services through the purchase of the Video Suite My Business Package.
Fees and Charges
All fees and charges due in advance of receiving access to packages.
By submitting your credit card or debit card information, you authorize NG to charge the credit/debit card for the total price for the package. In the event that you seek a chargeback, you will remain liable for the fees described in the website.
Any other charges will be agreed upon in writing prior to being charged, with a rate to be determined by NG.
Scope
The credentials purchased shall remain valid for one month (30 Days) from purchase date. There is no representation of any individual or entity contemplated, agreed upon, created, or authorized by this Agreement. Any answering of questions or general guidance provided by NG or its affiliates shall not alter this understanding, or create any new obligations on behalf of NG.
Names and IP Issues
WE DO NOT PROVIDE OPINIONS ON WHETHER A NAME IS AVAILABLE OR WHETHER YOU WILL POTENTIALLY INFRINGE ON ANOTHER’S RIGHTS.
It is advised that you independently conduct a thorough search of the Texas Secretary of State Website, as well as other state, local, and federal databases and trademarks for any potential infringement.
NG does not undertake any measures to ensure your selected business name is available or does not infringe any existing names or marks.
Information Verification
NG will undertake no efforts to verify any information you submit or use during your use of the Video Suite My Business package. Any records, documents, or statements made during the use of the package are entirely the responsibility of the User.
Registered Agent/Mailing Address
NG does not consent to serving as Registered Agent for any entity created with the Video Suite My Business package. NG will not undertake any responsibility for forwarding any mail delivered to or documents served on NG to an entity that has erroneously listed NG for any correspondence use.
Tax Issues and Advice
NG will not provide any advice on Tax Election status or eligibility.
Refunds
Due to the nature of the product being purchased, Refunds are handled only on a case by case basis, and are not guaranteed. Factors that will determine the award of a Refund will include: time of access to the materials, whether any of those materials were viewed or downloaded, whether the individual seeking the refund has filed any material with the Secretary of State of Texas, the frequency of requesting a refund, and any other factors that NG, at its sole discretion, may determine relevant to the granting of any refund requested.
Electronic Communication
Emailing, texting, or other forms of electronic communication may not be entirely secure and might be intercepted by unauthorized parties. Also, using devices that you do not own (like those owned by your employer) could mean that your communications are monitored by the device’s owner. Therefore, it’s advised not to share sensitive information using a device that belongs to someone else. You acknowledge that technology continuously changes and electronic communications are not entirely immune to interception by outsiders.
Chargebacks
If a chargeback is initiated or threatened against a purchase, we reserve the right to record this event in a chargeback abuser database of our choice, at our discretion. The details recorded will include your name, email, the date of the order, the amount, IP address, full postal address, and telephone number. Being recorded in such databases could severely restrict or even prevent your ability to make purchases using your credit card(s) with us or other businesses in the future. Individuals listed as chargeback abusers who wish to be removed from the database must settle any outstanding balances with us and pay an additional $50 for administrative costs.
Document Retention
No documents shall be retained by NG in relation to this matter.
Conflict of Interest
No conflict of interest check shall occur by NG in connection with this purchase.
Tax Acknowledgement and Disclosure
You are encouraged to seek independent and qualified tax advice since legal transactions may have tax implications. NG and its legal team are not obligated to provide tax advice and will not be responsible for guidance on tax-related matters or the preparation of any tax documentation, including, but not limited to, federal and state taxes on inheritance, sales, franchises, and income.
Liability Waiver
NG, its officers, directors, employees, or agents will not be liable for any indirect, punitive, special, incidental, or consequential damages, including but not limited to, losses of business, revenue, profits, use, data, or other economic benefits. This applies regardless of whether the damages arise from contract, negligence, or other tort actions, or from the use or inability to use this site or the materials it provides. This holds true even if NG has been advised of the possibility of such damages. If the use of this site’s materials results in the need for servicing, repair, or correction of equipment or data, you bear all associated costs. To the fullest extent permitted by law, your claims against NG, its officers, directors, employees, or agents for losses, costs, or damages shall not exceed $1,000 or the fees paid to the company, whichever is greater, regardless of the legal theory or cause of action.
Governing Law
These Terms and Conditions, and the relationship between you and NG (including any dispute), shall be governed by the laws of the State of Texas. The obligations of the parties are performable in Dallas County, Texas. These Terms and Conditions shall constitute the full and complete agreement between us.
Written Amendment
These Terms and Conditions may only be changed by mutual consent. Such consent shall be in writing and it is agreed that e-mail shall be considered writing for purposes of these Terms and Conditions.
